Q

ALB:您对房地产与建设工程的法律服务有哪些观察和经验?

张蕾律师:房地产与建筑业关系到国计民生,基础设施建设投资也是我国经济增长的重要推动力。近些年,房建市场比较困难,房建业务律师发展也受到影响。但我认为机遇和挑战是并存的,随着工程总承包、代建制以及工程建设全过程咨询等新兴法律服务衍生出了庞大的需求市场,当然,相应的法律事务也变得疑难和复杂,这就要求律师仅懂得法律知识是不够的,必须掌握房建行内规则和行业知识,才能把专业服务做到极致化。

同时,我经常向客户提议,要把法律服务下沉至项目源头,即在招投标、签约等流程之初就由律师团队介入。我和团队非常重视非诉讼业务,力图把潜在纠纷遏制在源头,即便后续发生纠纷也能做到有的放矢。

法律服务产品也可以根据市场需求来制定,我们将一些代理的经典案件转化为多个法律服务产品,并配备产品说明书、手册、操作流程,便于客户以浅显易懂的方式了解纠纷解决方式。

ALB:作为大成沈阳最年轻的管理层,您在带领团队方面有怎样的心得和“高光”时刻?

张蕾律师:律师单兵作战的时代已经过去。我创建了“玉成房地产与建设工程专业律师团队”,20多名成员包括了经验丰富的高级工程师、监理工程师、资产评估师、房企管理人员等兼具律师和专业特长的人才。经常有客户发现玉成团队的行业知识比自身公司专职人员还要专业,团队还具备制作工程造价报告的能力。我们通过强强联合来助力客户成功、捍卫客户利益,这也让客户对我们产生极大的信赖。

曾有一起涉外案件,一审在辽宁省高级人民法院审理,二审在最高人民法院本部审理,我们团队凭借专业优势以及日语、韩语的语言能力,取得完胜结果,该案被收录在《最高人民法院民商事案件裁判观点与实务评析》中。

ALB:未来您将如何继续与团队共同前行?

张蕾律师:业务方面,我会继续助力推动大成整体开发与高端引领相结合的模式,加强资源整合;服务客户方面,我会优先选择非诉讼解决方案,帮助客户高效处理案件,如果不得不启动诉讼,我也会寻求最快捷、成本低的方式,力求将每一次服务做到专业极致化。

另外,我会继续参加省、市律师协会各类活动,担起法治国家建设中的律师责任,并继续壮大律所公益法律服务志愿团队伍,不计得失、心怀热爱。我希望做一个“快乐星球人”,给身边的人带去温暖和幸福。


Building a strong team to maximize professional services

A veteran in the real estate and construction business, Zhang Lei was elected in 2022 as the deputy director of Dacheng Shenyang Management Committee for her outstanding leadership, professionalism, as well as quality and innovative services. She is the youngest member of the office management. Ms. Zhang has also been active on association activities in giving back to the community.

ALB: What are your observations and experiences about legal services in the real estate and construction sector?

Zhang Lei: The sector is critical to the national economy and the people's livelihood, and infrastructure investment has been a key economic driver in China. Our business suffered from the recent downturn in the real estate and construction sector. However, I believe that opportunities come along with challenges. A vast market is created for new legal services such as EPC, the agent-construction system, and whole process engineering consulting. Faced with even more complicated legal services, lawyers should expand their knowledge base to include more industry rules and expertise before they can serve clients the best.

I often advise clients to introduce legal services from the beginning, i.e. bidding and contracting process. Our team attaches great importance to the non-litigation business as we try to forestall potential disputes and provide target solutions even before disputes arise.

We also develop market-oriented legal service products. For example, some classic cases have been translated into products with supporting product manuals, handbooks, and operating procedures, an easy-to-understand display to clients of how disputes are resolved.

ALB: What are your tips and "highlights” in leading your team as the youngest member of the office management?

Zhang Lei: The era of lawyers fighting solo has passed. I have built a professional team “Yucheng” of more than 20 experienced members, including lawyers, senior engineers, supervising engineers, asset appraisers, and real estate managers. Our team has been recognized by many clients for demonstrating more professional industry insights than their insiders and preparing project cost reports. By pooling wisdom and strength, our team works to help our clients succeed and defend their interests, which builds their trust in us.

We have a foreign-related case heard at first instance in Liaoning High People's Court and at second instance in the headquarters of the Supreme People's Court. Our professional and language advantages have secured success in both instances and the case was included in the "Opinions and Practical Comments on Civil and Commercial Cases of the Supreme People's Court".

ALB: How will you move forward with your team?

Zhang Lei: In terms of business, I will continue to help Dacheng integrate resources in general and premium services. While advising on clients, I will prioritize efficient non-litigation solutions and find the quickest and most cost-effective way to initiate a lawsuit when it is necessary. I will work toward professionalism and excellence in everything I do.

In addition, I will continue to take part in provincial and municipal association activities, do my job as a lawyer in China’s efforts to build a rule of law society, and grow Dacheng's team of volunteer lawyers who are committed to helping those in need with our public legal services. I want to be someone who can always bring warmth and happiness to the people around.
