Eva Niu is a partner at Dentons Beijing office and is qualified both China and US (New Jersey and New York). She specializes in cross-border transactions and dispute resolution related to international commerce. She litigates international related commercial and investment disputes throughout China and sits as counsel before arbitration tribunals, including China International Economic and Trade Arbitration Commission (CIETAC) and International Chamber of Commerce (ICC).

In connection with her extensive litigation background, Ms. Niu helps clients navigate risks and achieve their objectives in cross border transactions, with a particular focus on corporate governance, internal compliance, and export control. She also advises clients on employment policies and handles disputes on individual and collective employment contracts.

She is active in the NGO sector and routinely advises nonprofits and associations at the intersection of laws and policy, with a particular emphasis on poverty relief and education. She has advised International Red Cross, University of Edinburgh, Notre Dame University, and various schools and education institutes on their operation in China. She served on board of trustees in two of the international schools in Beijing for 7 years and advised numerous private schools in the establishment and closing process.

Cross-border Dispute Resolution

  • Shareholder Disputes in CIETAC: Represented a German company in shareholder dispute against its Chinese shareholder in CIETAC.
  • International Sales Dispute in ICC Singapore: Represented a state-owned enterprise in international sales dispute against the Spanish purchaser in ICC in Singapore.
  • Cross-Border Cooperation Dispute in ICC New York: Represented a state-owned enterprise in its contract dispute with a US company in ICC in New York.
  • International Construction Dispute in CIETAC: Represented a state-owned enterprise in its construction dispute in Pakistan.
  • Enforcing Foreign Arbitral Award: Represented a Korean electronics company to enforce its ICC arbitral award in Wuhan, Hubei.
  • Service Dispute in CIETAC and Enforcing CIETAC Award in Beijing: Represented a foreign state Opera House in cooperation dispute against a Chinese Opera House and enforce the CIETAC arbitral award.

Export Control & Sanction Compliance

  • Multiple Chinese SOEs and public listed companies: Advised them in various industries, including oil, infrastructure, telecommunication, steel and mechanics, related to compliance with US export control and Sanctions regulations.
  • ZTE: Advised the company on its data protection in process of complying with US requirements.

Corporate Compliance

  • China Unicom: Advised the company on its investment in a joint-venture agreement with Telefronica.
  • Subway: Advised it on its franchising filing and operating in China.
  • Airbus China: Advised it on its employment policies and employment agreements.
  • Oman Air: Advised the airline on its internal employment policy to comply with Chinese national and local rules, helped to obtain proper visa for its foreign expatriates, and provided solutions to its local hires.
  • Lem China: Advised the Chinese branch of the Swiss manufacturer on its internal compliance policies, including internal control, sales, import and export, and employment related matters; represented Lem China in multiple employment arbitration and litigation.
