Dentons Successfully Defends ZTE in Turkey’s Safeguard Measures against Imported Cellphones

On March 4, 2016, the Ministry of Economy of Turkey announced a final decision that the Turkish government would not adopt any safeguard measures against imported cellphones (including smartphones).

On December 5, 2014, Turkish Ministry of Economy started investigating imported cellphones after Turkey’s Vestel Electronics called for the ministry to take safeguard measures. ZTE Corporation, being the largest smartphone exporter to Turkey, was much concerned and called on Dentons senior partner Cai Kaiming, who has been a standing legal counsel for the company, to represent it in forthcoming legal actions. Cai’team, in collaboration with ALBARS, a local law firm renowned for representing clients in trade remedy cases, cited relevant precedents and submitted strong defense opinions and evidence materials. In the hearing session held by Turkish Ministry of Economy, the attorneys made a full statement to the investigating officers.

At the same time, Cai cooperated with Chinese Ministry of Commerce and China Chamber of Commerce for Import and Export of Machinery and Electronic Products to work on the defense. He also communicated with the Turkish Ministry of Economy, other foreign industry associations, and consumer associations. After more than 15 months of hard work, the ruling was issued in ZTE’s favor.
