In July 2015, upon acceptance of the entrustment of Capital Airport Real Estate Development (Chongqing) Co., Ltd (hereinafter referred to as “CARE Chongqing”) under Capital Airport Real Estate Group Co., Ltd, Dacheng Chongqing Office provided special legal services to “CARE Chongqing” in cooperation with famous primary and middle schools to run a private school in its real estate project “CARE • Jiangshanfu”.
Capital Airport Real Estate Group Co., Ltd is a well-known state-owned real estate development enterprise in China, and is subordinate to Capital Airport Holding Company. It is the main direction for the company to develop “Airport Property” projects by relying on the radiation advantage of the local civil airports. The company has developed large and high-quality “Airport Property” projects in Beijing, Jilin, Hainan, Jiangxi, Inner Mongolia, etc, and “CARE • Jiangshanfu” is the first project for the company to march into the real estate market of Chongqing. Its wholly-owned subsidiary “CARE Chongqing” is responsible for developing the project. The project is located in the core area of Yuelai housing group of Yubei District, Chongqing (Liangjiang New Area), with a land area of about 850 Chinese mu and a total development area of about 1.5 million m2. The project is planned with such education facilities as kindergartens, a primary school and a middle school, among which there are two kindergartens, with a total land area of 4,750 m2 and the planned floorage of 4,100 m2; the planned primary school will have a scale of 60 classes, with a land area of 39,549 m2; the planned middle school will have a scale of 80 classes, with a land area of 87,956 m2. It is planned to invest more than RMB 700 million in the educational facilities.
“CARE Chongqing” intends to build “CARE • Jiangshanfu” Project into a big education project in Yubei District, by cooperating with well-known primary and middle schools of Chongqing to run private schools with the project land for the purpose of education. “CARE Chongqing” entrusted Dacheng to provide such specific legal services as project survey, risk prevention and control and issuance of legal opinions for the matters of co-running schools.
Upon acceptance of the entrustment, Dacheng’s Chongqing Office assigned a panel formed by attorneys Wen Zhaohui, Lei Jun and Zhang Jie to conduct a pre-investigation as required by “CARE Chongqing” and with reference to the corporate nature of “CARE Chongqing” and the situations of the project. The team surveyed Chongqing Foreign Language School (CQFLS), Chongqing Rongchang District “Dacheng Middle School”, Chongqing Bashu Primary School, Chongqing Nankai Middle School, Chongqing Yubei District Education Commission and other institutions. With the complete and thorough survey, the team members obtained a huge amount of first-hand information and had an in-depth understanding of the development and structure of education industry in Chongqing. Based on the pre-investigation, the team members issued detailed legal opinions twice for “CARE Chongqing” in terms of analysis on school-running mode, legal risk prevention and control and implementation of school-running plans. “CARE Chongqing” has high praise for Chongqing Office for its legal advice as well as adequate recognition and appreciation for Wen Zhaohui, Lei Jun and Zhang Jie for their professional, quality and efficient services.
