Dentons advises DNB Bank Polska on financing of development of five wind farms

Global law firm Dentons advised DNB Bank Polska S.A. in connection with the financing of the construction of five independent wind farms located in the Wielkopolskie region, an investment comprising 13 wind turbines with a total capacity of more than 26 MW. The financing of PLN 155 million (€35 million) was granted to the special purpose vehicle Wilko 5 Sp. z o.o. controlled by Helios Energy Investments Fund.

Dentons lawyers prepared, negotiated and organized the signing of the finance documents on the part of the bank, verified the due diligence report, and provided advice on renewable energy sources (RES) and environmental regulations.

This is the fourth project financed by DNB Bank Polska in the renewable energy sector since the entry into force of the new RES support system and the third one implemented in cooperation with Dentons. In 2019, Dentons advised a consortium of six banks, including DNB, in connection with financing the construction of the Potęgowo wind farm with a total capacity of 220 MW. In 2020, Dentons supported DNB Bank Polska and another lender in financing of a wind farm with a capacity of over 140 MW.

The transaction was supervised by partner Mateusz Toczyski, and was led by Piotr Nerwiński (managing counsel) with support from Jakub Walawski (associate) from the Dentons Banking and Finance practice. Agnieszka Kulińska (partner), Jan Dubiński (senior associate) and Lena Boczkaja (senior associate) from the Energy and Natural Resources practice advised on the project and regulatory issues.
